PETITION FOR ORDER PROBATING WILL, APPOINTING PERSONAL REPRESENTATIVE, ADJUDICATING ESTATE TO BE SOLVENT, AND DIRECTING ADMINISTRATION WITHOUT COURT INTERVENTION

Petitioner, MARIE ANN CHEATHAM, respectfully shows:

I. JURISDICTION: Decedent died on February 7, 2001, in Battle Ground, Washington, and at the time of her death, was a resident of Battle Ground, Washington, and left property in Clark County, Washington, subject to probate.

2. TESTACY: Decedent died testate, having duly executed her Last Will and Testament which is dated April 24, 2000, in the presence of Rita M. Wilson and Joyce E. Kujava, competent witnesses, who subscribed their names to the Will in the presence of decedent and at her request.

3. HEIRS, DEVISEES AND LEGATEES: The decedent was survived by the following heirs, legatees, and devisees:

4. PETITIONER Petitioner is a resident of the State of Washington. Said petitioner is the personal representative nominated and appointed by decedent in her Will, and that said petitioner willing and qualified to act, Said Will provides that Petitioner shall serve without bond and with nonintervention powers.

5. REQUEST FOR ORDER OF SOLVENCY: Petitioner is well acquainted with the decedent's affairs, has reviewed the decedent's records and papers, and has determined that the decedent's assets are well in excess of liabilities, expenses of last illness, funeral and burial expenses, taxes, and costs of administration, and believes the estate to be fully solvent. The estimated gross value of assets subject to probate is $57,000 00, which consists of the following assets:

Bank Account - none subject to probate

Investment Accounts $ 39,000.00
Vehicle $ 16,000 Household Goods & Furnishings  $ 2,000

Total Assets; $ 57,000

The liabilities of decedent are to be paid out of joint bank account, including funeral expenses.

That notice of this Petition for Order of Solvency is not required to be given because the Petitioner is named as Personal Representative in decedent's Will and there is no surviving spouse.

WHEREFORE, Petitioner prays that the above-entitled Court enter an Order as follows:

(a) Admitting the Will of the decedent to probate, confirming the appointment of Petitioner as Personal Representative of decedent's estate, and directing that Letters Testamentary be issued to Petitioner;

(b) Adjudging the estate of the decedent to be solvent, and

(c) Directing that further administration thereof shall be in accordance with the laws of the State of Washington pertaining to the settlement of estates without bond and without the intervention of Court.
